On December 17, 2007 Prime Minister Stephen Harper announced the introduction of Canada’s Food and Consumer Safety Action Plan (the “Action Plan”). The objective of the Action Plan is to modernize and strengthen Canada’s safety system for food and consumer products. New legislation supporting the Action Plan will likely be introduced shortly.
Businesses engaged in the importation, sale and distribution of food and consumer products in Canada should keep informed. The new provisions will, amongst other things, provide for clear authority for mandatory product recalls and the issuance of warnings. New legislation will also provide officials with the power to discuss product development at an early stage with manufacturers; make scientific and regulatory advice binding; and permit inspectors to detain, prohibit or restrict the movement of food for compliance verification purposes. An updated penalty system for contraventions will also be established.
